NeoMedia Technologies Agrees to Settlement with AirClic


FORT MYERS, Fla., July 12, 2005 – NeoMedia Technologies, Inc. (OTC BB: NEOM), an innovator in wireless services and patented technologies that provide automatic links to Internet-based information, said today that it has reached an out-of-court settlement agreement with AirClic™, Inc., of Newtown, Pennsylvania, a provider of mobile process automation solutions. In April 2004, NeoMedia sued AirClic, charging patent infringement, and AirClic filed a suit seeking to invalidate several of NeoMedia’s patents.

While terms were not made public, Charles W. Fritz, founder and chairman of NeoMedia, said the agreement calls for AirClic to compensate NeoMedia and set a schedule for future compensation by AirClic, with the companies dropping their respective lawsuits while leaving open the possibility of future collaborative efforts.

Mr. Fritz said AirClic did not receive a license to use NeoMedia’s patented PaperClick® technology, and that the companies agreed that AirClic’s current business model – mobile enterprise solutions – is not in NeoMedia’s space.

NeoMedia, whose PaperClick platform automatically bridges codes and key words direct to mobile content and Internet sites, “is happy to have litigation and settlement talks with AirClic behind us,” Mr. Fritz said.

“Each company has enormous opportunity, yet in very different markets,” said John E. Parker, president of AirClic. “Given the reality of how far our respective business models have diverged over the years, we are satisfied with this outcome.”

This is the second settlement reached by NeoMedia in recent weeks. On June 29th, NeoMedia announced that Virgin Entertainment had agreed to license PaperClick technology through 2016.
